What is the robbery charge?
While the terms “robbery” and “theft” are often used interchangeably when talking about the stealing of someone else’s property, they are two separate criminal charges in Canada.
Unlike theft, robbery is carried out with the use of force, a weapon, or the threat of violence. In many cases, robbery is committed with the use of a deadly weapon such as a knife or gun, but you could be found guilty of robbery if you use any weapon or something that resembles it to threaten another person and steal their property.
Types of robbery
Under Section 343 of the Criminal Code, you can be found guilty of robbery when you carry out the theft of another person’s property with violence or threat of violence.
Different situations in which you can be charged with robbery include:
- Stealing someone else’s property and using violence or threat of violence for the purpose of extorting the stolen property or overcoming resistance;
- Stealing from a person and using any personal violence immediately before or after the illegal act;
- Assaulting another person with the intent to steal something from them; and
- Stealing from another person while carrying or wearing a weapon or imitation of a weapon.
What are the penalties for the robbery charge?
Pursuant to the Criminal Code, robbery is prosecuted as an indictable offence. Under certain circumstances, the offence of robbery can carry a mandatory minimum penalty.
- A minimum sentence is four years in jail if the robbery is committed with the use of a weapon.
- If the defendant commits the offence while being associated with or at the direction of a criminal organization, a minimum sentence is five years (for a first offence) or seven years (for a second and any subsequent offence).
Life imprisonment is the maximum sentence for robbery. Other negative consequences of a robbery conviction include:
- The loss of employment
- Travel or immigration restrictions
- Having a criminal record
- Ineligibility for certain jobs and professions
