Pursuant to the Criminal Code, robbery is prosecuted as an indictable offence. Under certain circumstances, the offence of robbery can carry a mandatory minimum penalty.
  1. A minimum sentence is four years in jail if the robbery is committed with the use of a weapon.
  2. If the defendant commits the offence while being associated with or at the direction of a criminal organization, a minimum sentence is five years (for a first offence) or seven years (for a second and any subsequent offence).
